DH Spirit Terms of Services

Welcome, and thank you for your interest in DH Spirit, LLC (“DH Spirit,” “we” “us,” or “our”) and our
website at www. DH Spirit.com, along with our related websites, networks,
applications, mobile applications, and other services provided by us
(collectively, the “Service”). These Terms of Service
are a legally binding contract between you and DH Spirit regarding your use of
the Service.
BY CLICKING “I ACCEPT,” OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE
SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO
YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY, THE FOLLOWING
TERMS AND CONDITIONS, INCLUDING DH SPIRIT’S PRIVACY POLICY AND COMMUNITY
GUIDELINES (TOGETHER, THESE “TERMS”). IF YOU ARE
NOT ELIGIBLE OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION
TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND DH SPIRIT’S PROVISION OF THE
SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY DH IRIT AND BY YOU TO BE BOUND BY
THESE TERMS.
ARBITRATION NOTICE. Except for certain kinds of disputes
described in Section 16, you agree that disputes arising under these Terms will
be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND DH SPIRIT ARE EACH WAIVING THE
RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR
REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to
assert or defend your rights under this contract (except for matters that may
be taken to small claims court). Your rights will be determined by a neutral
arbitrator and not a judge or jury. (See Section 16.)
11. Digital Millennium Copyright Act
DH SPIRIT IS NOT RESPONSIBLE FOR THE ACTIVITIES OF ANY USER, FAITH
LEADERS, FAITH COMMUNITIES, DONEES, OR OTHER ORGANIZATIONS THAT MAY USE,
OR THAT YOU MAY ENCOUNTER OR INTERACT WITH THROUGH THE SERVICE. DH SPIRIT
MAKES NO REPRESENTATION OR WARRANTIES AS TO THE ACCURACY OF STATEMENTS
MADE ON THE SERVICE BY DONEES OR OTHER USERS.
NO ADVICE OR INFORMATION, WHETHER o*** OR WRITTEN, OBTAINED BY YOU FROM
THE SERVICE OR DH SPIRIT ENTITIES OR ANY MATERIALS OR CONTENT AVAILABLE
THROUGH THE SERVICE WILL CREATE ANY WARRANTY REGARDING ANY OF THE DH
SPIRIT ENTITIES OR THE SERVICE THAT IS NOT EXPRESSLY STATED IN THESE
TERMS. WE ARE NOT RESPONSIBLE FOR ANY DAMAGE THAT MAY RESULT FROM THE
SERVICE AND YOU’RE DEALING WITH ANY OTHER SERVICE USER. YOU UNDERSTAND AND
AGREE THAT YOU USE ANY PORTION OF THE SERVICE AT YOUR DISCRETION AND RISK
AND THAT WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR PROPERTY (INCLUDING
YOUR COMPUTER SYSTEM OR MOBILE DEVICE USED IN CONNECTION WITH THE SERVICE)
OR ANY LOSS OF DATA, INCLUDING USER CONTENT.
THE LIMITATIONS, EXCLUSIONS, AND DISCLAIMERS IN THIS SECTION APPLY TO THE
FULLEST EXTENT PERMITTED BY LAW. DH Spirit does not disclaim any warranty
or other right that DH Spirit is prohibited from disclaiming under
applicable law.
EXCEPT AS PROVIDED IN SECTION 16.4 AND TO THE FULLEST EXTENT PERMITTED BY
LAW, THE AGGREGATE LIABILITY OF THE DH SPIRIT ENTITIES TO YOU FOR ALL
CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE
ANY PORTION OF THE SERVICE OR OTHERWISE UNDER THESE TERMS, WHETHER IN
CONTRACT, TORT OR OTHERWISE, IS LIMITED TO $10.
EACH PROVISION OF THESE TERMS THAT PROVIDES FOR A LIMITATION OF LIABILITY,
DISCLAIMER OF WARRANTIES, OR EXCLUSION OF DAMAGES IS INTENDED TO AND DOES
ALLOCATE THE RISKS BETWEEN THE PARTIES UNDER THESE TERMS. THIS ALLOCATION
IS AN ESSENTIAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN THE PARTIES.
EACH OF THESE PROVISIONS IS SEVERABLE AND INDEPENDENT OF ALL OTHER
PROVISIONS OF THESE TERMS. THE LIMITATIONS IN THIS SECTION 15 WILL APPLY
EVEN IF ANY LIMITED REMEDY FAILS IN ITS ESSENTIAL PURPOSE.

Privacy Policy
This Privacy Policy (“Policy”) describes how DH Spirit, LLC. (“DH Spirit”, “we,” “us,” or “our”) collects and uses Personal Information in the context of our website at DH Spirit.com (the “Site”), as well as all related websites, networks, applications, and other services provided by us and on which a link to this Policy is displayed (collectively, together with the Site, our “Service”). This Policy describes the Personal Information that we gather from you on the Service, how we use and disclose such Personal Information, and the steps we take to protect such Personal Information.
In this Policy, “Personal Information” means any information relating to an identified or identifiable individual. We may collect Personal Information about you directly from you and third parties, as well as automatically through your use of the Service. When you create or update your profile on the Service, you may provide us with profile information, such as information about your religious denomination, your church attendance frequency, your social and religious leanings, your preferred Bible translation, and whether you act in a religious or ministry leadership capacity, your location, and any other information you choose to include on your profile.
· User-Generated Content. When you share content through the Service, we may receive your user-generated content, such as photos, videos, text, or any other media you choose to share publicly, privately, or with other users.
· Contact Uploads. When you invite others through the Service, we may store the phone numbers and/or email addresses of users you have selected to invite.
2. As we are a religious social network, some of the information you provide may reveal your religious beliefs or political opinions. Where required by applicable law, we will only collect and use such information with your consent. Your data are stored on secure servers in the United States.
· Service Usage Information. When you use our Service, we may collect information about your use of the Service, such as your IP address, web browser, device type, and the web pages that you visit just before or just after you use the Service, as well as information about your interactions with the Service, such as the date and time of your visit, and where you have clicked.
· Location Information. We may obtain information about your physical location, such as by use of GPS and other geolocation features in your device, or by inference from other Personal Information we collect. For example, your IP address indicates the general geographic region from which you are connecting to the Internet.
· Cookies and Similar Technologies. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Service.

Please be aware that if you opt-out of receiving commercial emails from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period. Additionally, even after you opt-out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Service.

We are not responsible for the content or privacy and security practices and policies of third-party sites or services to which links or access are provided through the Service. 2. The Service uses the YouTube API to transmit, store, and display video content uploaded by The Service and its users. By agreeing to this agreement, you acknowledge the Google Privacy Policy (http://www.google.com/policies/privacy) and agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).
Protecting the privacy of young children is especially important. Our Site is a general audience site not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13 without obtaining parental consent.
We use certain physical, organizational, and technical safeguards that are designed to maintain the integrity and security of the information that we collect. Please be aware that no security measures are perfect or impenetrable and thus we cannot and do not guarantee the security of your information. It is important that you maintain the security and control of your credentials, and not share your passwords with anyone.
The Service is hosted in the United States. We make no representation that the Service is appropriate or available for use outside of the United States. Access to the Service from countries or territories or by individuals where such access is illegal is prohibited.
If you are located in the European Economic Area, we will comply with applicable data protection laws when transferring your Personal Information outside of the European Economic Area.
